NOTICE OF INTENTION TO AMEND ZONING BYLAW NO. 5346

The Council of the City of Moose Jaw intends to consider a bylaw pursuant to The Planning and Development Act, 2007 to amend the City of Moose Jaw’s Zoning Bylaw No. 5346.

Since the proposed Zoning Bylaw text amendment impacts all properties in the C2 – High Density Commercial District, all property owners within that district and within a 90 m buffer around the C2 properties have been issued this notice.

Area Impacted: All properties within the C2 – High Density Commercial District

Application:

As shown in the map above, the C2 District chiefly comprises the downtown commercial core, the Town & Country Mall, and the South Hill commercial area. This district is intended “to provide an area with a wide range of commercial, institutional, and residential uses in high-density form.”

The C2 District is not primarily intended for One-Unit Dwellings since these represent low-density built form and are not generally an efficient use of the City’s central commercial lands. However, the Zoning Bylaw allows One-Unit Dwellings as at Council’s discretion in the C2 District, to account for exceptions. Such dwellings exist in limited cases; mostly along the district fringe where it abuts nearby residential districts.

The City has recently received an application from one such resident on the C2 fringe to amend the zoning for their property to allow a Secondary Suite within their One-Unit Dwelling. Secondary Suites can only be built within One-Unit Dwellings. Rather than make a one-off, reactive zoning change for this property and reduce the long-term availability of core commercial land in the City, City Administration would prefer to address the underlying issue by allowing Secondary Suites across the C2 wherever a One-Unit Dwelling has already been approved by Council.

The proposed amendment would allow Secondary Suites as a Permitted Use within the C2 district where they are currently prohibited. Since One-Unit Dwellings in this district require discretionary approval by virtue of their low-density form, adding a secondary suite to an approved One-Unit Dwelling makes the property relatively more consistent with the C2 District objectives. One additional parking space will be required for the Secondary Suite.
